Malaysiakini Kena Saman






Prime Minister Datuk Seri Najib Razak filed a defamation suit against online news portal Malaysiakini last Friday. According to Bernama, Najib filed the suit together with Umno’s executive secretary Datuk Abdul Rauf Yusoh. It is learnt that the suit named Malaysiakini’s publisher, editor-in-chief-Steven Gan and chief editor Fathi Aris Omar as defendants.

 Meanwhile, Malaysiakini said the writ and statement of claim was hand-delivered to their office in Bangsar today, adding that case management had been set for June 18. 

 On May 15, Malaysiakini received a letter of demand from law firm Hafarizam Wan & Aisha Mubarak, citing a compilation of readers’ comments in two articles under their Yoursay column — “A case of the PM reaping what he sows” and “How much will Najib spend to keep Terengganu”. The comments had been deemed defamatory and the letter also highlighted that six comments were also seditious. 

 Lawyer Mohd Hafarizam stated in the letter, as quoted by Malaysiakini, that the “accusations made by users on the news portal were totally baseless, without concrete proof and were very serious, on top of having ill-intent (mala fide) to damage the reputation and image of our clients”. Among the demands made in the letter was that Malaysiakini must apologise unconditionally within 48 hours from the issuance of the letter. 

The letter also demanded a retraction of the said articles. Apart from that, Malaysiakini was asked to be careful in publishing readers’ comments. If a response is not given, the law firm had received instructions to initiate court action.
